Limited Warranty

This Limited Warranty applies to fiberglass pergola structures manufactured by Baldwin Pergolas, 440 Middlefield Street, Middletown, Connecticut 06457.

1. Structural Materials Warranty

Baldwin Pergolas warrants that its fiberglass reinforced polymer (FRP) structural members, fiberglass columns, cast fiberglass capitals and bases, aluminum structural connection components, and stainless steel structural hardware shall be free from defects in materials and manufacturing for a period of ten (10) years from the date of installation.

If a covered defect is discovered during the warranty period, Baldwin Pergolas shall, at its sole option, repair or replace the defective component.

This warranty applies only to defects in materials or manufacturing and does not apply to damage resulting from:

• Improper installation by others
• Unauthorized modifications or alterations
• Settlement, movement, or failure of foundations or supporting structures
• Vehicle impact, vandalism, abuse, or misuse
• Wind, snow, seismic, or other loads exceeding the design criteria specified for the project
• Fire, flood, lightning, hurricanes, tornadoes, earthquakes, or other Acts of God
• Exposure to chemicals, pollutants, or environmental conditions beyond normal service conditions

2. Workmanship Warranty

Baldwin Pergolas warrants its fabrication workmanship and, where installation is performed directly by Baldwin Pergolas, its installation workmanship, for a period of two (2) years from the date of installation.

This warranty covers defects resulting directly from errors in fabrication or installation.

For projects installed by third parties, Baldwin Pergolas warrants only the manufacturing workmanship of the supplied components.

3. Factory Finish Warranty

Baldwin Pergolas warrants its factory-applied finish system against peeling, blistering, or loss of adhesion caused by defects in factory application for a period of one (1) year from the date of installation.

This warranty does not cover:

• Normal weathering
• Color fading
• Gloss reduction
• Chalking
• Surface dirt accumulation
• Abrasion or physical damage
• Damage caused by cleaners, solvents, pressure washing, or chemicals
• Field-applied coatings or touch-up systems applied by others
• Standing water, blocked drainage paths, or conditions preventing normal ventilation and drying of painted surfaces
• Moisture intrusion resulting from modifications, penetrations, or attachments made after delivery

Because paint manufacturers do not warrant labor associated with repainting, Baldwin Pergolas' obligations under this finish warranty shall be limited to repair, refinishing, or replacement of the affected component, at Baldwin Pergolas' sole discretion.

4. Stainless Steel Hardware

Baldwin Pergolas warrants stainless steel structural hardware supplied by Baldwin Pergolas against corrosion failure for the useful life of the structure under normal environmental conditions.

Surface discoloration, staining, or cosmetic changes that do not affect structural integrity are not considered corrosion failure.

5. Warranty Claim Procedure

The Owner shall notify Baldwin Pergolas in writing within thirty (30) days of discovery of any claimed defect.

Notification shall include:

• Project name and address
• Date of installation
• Description of the claimed defect
• Photographs documenting the condition

Baldwin Pergolas reserves the right to inspect the installation before determining warranty coverage.

6. Exclusive Remedy

The remedies described in this warranty are the sole and exclusive remedies available to the Owner.

Baldwin Pergolas shall, at its sole option:

• Repair the defective component,
• Refinish the defective component, or
• Replace the defective component.

Replacement components may differ slightly from original components due to changes in manufacturing processes, materials, or finishes.

7. Limitation of Liability

Baldwin Pergolas' total liability under this warranty shall not exceed the original purchase price of the defective component.

Under no circumstances shall Baldwin Pergolas be liable for:

• Consequential damages
• Incidental damages
• Loss of use
• Loss of profits
• Loss of business opportunity
• Costs associated with removal of landscaping, paving, utilities, or adjacent construction
• Contractor overhead, supervision, or delay claims

8. Transferability

This warranty is transferable to subsequent property owners during the warranty period, provided the structure remains at its original installation location and has not been modified.

9. Entire Warranty

This document constitutes the entire warranty provided by Baldwin Pergolas. No dealer, contractor, installer, architect, engineer, salesperson, or representative is authorized to modify or extend this warranty without written approval from Baldwin Pergolas.
